LMIA Applications
The LMIA process starts with the employer applying to Employment and Social Development Canada (ESDC), providing details about the job offer. ESDC assesses the application to determine if hiring a foreign worker is necessary and beneficial for the Canadian labor market. If approved, the employer receives a positive LMIA, allowing them to offer the job to a foreign worker. The foreign worker can then use this positive LMIA to apply for a work permit through Immigration, Refugees, and Citizenship Canada (IRCC).

How to Obtain an LMIA:
- Job Advertisement
Before applying for LMIA, employers must advertise the job vacancy in Canada for a specific period. This step is essential to demonstrate that no qualified Canadians are available for the position.
- Preparing the Application
The employer must prepare a detailed application that includes information about the company, the job position, and the efforts made to recruit locally. This application should be thorough and well-documented.
- Application Submission
Once the application is complete, it should be submitted to Employment and Social Development Canada (ESDC) or Service Canada, depending on the location of the job.
- LMIA Assessment
ESDC or Service Canada will review the application to ensure it meets the LMIA requirements. This includes assessing the impact of hiring a foreign worker on the Canadian labor market.
- Decision
After careful consideration, ESDC or Service Canada will issue a decision on the LMIA application. If approved, the employer can proceed with hiring a foreign worker.
