Who Can You Sponsor?

Canada’s family sponsorship program allows eligible sponsors to sponsor a spouse, common-law partner or, in specific circumstances, a conjugal partner for permanent residence

Spouse

A person you are legally married to and whose marriage is legally recognized for Canadian immigration purposes.

Common-Law Partner

A partner with whom you have lived in a conjugal relationship for at least 12 consecutive months.

Conjugal Partner

A partner living outside Canada with whom you have been in a committed conjugal relationship for at least one year, where marriage or continuous cohabitation has not been possible

Who Can Sponsor a Spouse or Partner in Canada?

To sponsor your spouse or partner for permanent residence, you must meet Canada’s sponsorship eligibility requirements.

Basic Sponsor Requirements

You may be eligible to sponsor your spouse or partner if you are at least 18 years old and are a Canadian citizen, permanent resident, or a person registered in Canada under the Indian Act. You must also meet the applicable sponsorship requirements and not be subject to a sponsorship restriction.

Financial Requirement

In most spouse and partner sponsorship applications, there is no minimum income requirement. However, the sponsor must generally demonstrate that they can support the sponsored family member and meet the financial obligations of the sponsorship undertaking.

Important: A minimum income requirement may apply in certain cases involving dependent children who have dependent children of their own.

Spousal Sponsorship: In Canada or Family Class?

The appropriate sponsorship class depends on your circumstances, including where the sponsored person is living and whether the couple is living together in Canada.

Spouse or Common-Law Partner in Canada Class

For eligible spouses or common-law partners who are living together in Canada. This class may also provide access to an open work permit for eligible sponsored applicants while the permanent residence application is being processed.

Family Class

Commonly used when the sponsored spouse or partner is living outside Canada. It may also be suitable for couples living together in Canada where the applicant does not plan to remain in Canada throughout processing. If an interview is required, it may take place outside Canada at the visa office processing the application.

Proving a Genuine Relationship

IRCC assesses whether the relationship is genuine and was not entered into primarily for the purpose of acquiring immigration status in Canada. The evidence required will depend on the couple’s relationship history and circumstances.
