Canada announces various public policies for immigration impacted by covid-19

Due to COVID-19, if you apply for extension of open work permit by july 2021, you may be eligible to receive extra up to 18 months.

Who are eligible to apply?

to meet the eligibility for this programs, you must be in the following conditions:

  1. Your post-graduation work permit (PGWP)

A. expired on or after January 30, 2020, or

B. will expire within 4 months from the date you apply for this open work permit.

2. You were in Canada as of January 27, 2021, when the public policy took effect, and have stayed in Canada since then.

3. You either

A. have a temporary resident status (this could be from having a valid PGWP, visitor record, or another permit that allows you to stay in Canada), or

B. lost your temporary resident status, but you’ve already applied to restore it, or

C. lost your temporary resident status, but you are applying for restoration of your status at the same time as applying for this open work permit.

4. You include in your application that you’re applying for an open work permit under this public policy.

5. You have a valid passport. it means that your passport must be at least valid for 18 months at the date of approval otherwise your work permit will be issued to its expiry date if its less than 18 months.

Public policy for temporary residents

Due to covid-19, there are a number of foreign nationals who have to stay in canada for a longer period of time. To make sure that they can stay in Canada legally, Canadian government has announced another public policy for them.

Through this policy, foreign nationals can apply for extension and restoration of their temporary resident visa.

There are some requirements to apply:

  • Foreign nationals (visitors, temporary workers and international students) who have fallen out of status during the COVID-19 pandemic (i.e., between January 30, 2020, and May 31, 2021) now have more time to restore their temporary resident status.
  • Foreign nationals are exempt from the requirement that work or study permit not be issued if they have not complied with certain temporary resident conditions.
  • Allow eligible temporary workers applying for a work permit supported by a job offer, to work while a decision on their restoration application is pending. This includes former workers who have applied or will apply, within 90 days of losing their temporary resident status, and those availing themselves of the public policy exemption to apply after 90 days have passed.
