LMIA-Based Work Permit

A Labour Market Impact Assessment (LMIA) is a document that an employer in Canada may need to get before hiring a foreign worker.A positive LMIA will show that there is a need for a foreign worker to fill the job.

Obtaining an LMIA-based work permit involves a two-step application process.
Step 1:
You apply for an LMIA through Service Canada. The purpose of this LMIA is to ensure that foreign workers are not being selected for jobs where Canadian citizens or permanent residents are available. A positive LMIA confirms that hiring foreign nationals for the specified occupation and work location is likely to have a positive or neutral impact on the Canadian labor market.

Step 2:
The second step comes after an employer has received a positive LMIA from Service Canada. At this point, you can apply for a work permit, which is submitted to Immigration, Refugees, and Citizenship Canada (IRCC).

Proof of employment in Canada: A copy of the Labour Market Impact Assessment (LMIA) and a copy of your employment contract from your future employer.

You have the option to apply for a work permit online through the official immigration portal. Alternatively, you can choose to go to a designated Port of Entry border crossing to apply for a work permit in person. The choice between these two methods often depends on your specific circumstances, preferences, and the policies you’re applying to work in.

Check your Eligibility

To make sure a job offer is genuine when applying for a work permit, it must be complete and come from a real organization that can provide stable employment. The employer should also prove they can meet the job's hours, pay, and benefits throughout the work permit's duration. Plus, everyone involved in hiring the worker should follow the employment and recruitment rules in the area where the job is located to ensure legal compliance.

FAQ's

An LMIA-based work permit in Canada is a type of work permit that allows foreign workers to work in the country in specific job positions for which the employer has obtained a positive Labour Market Impact Assessment (LMIA) from Employment and Social Development Canada (ESDC).
No, not every job in Canada requires an LMIA. LMIA is typically required when employers cannot find suitable Canadian citizens or permanent residents to fill certain job positions. There are LMIA-exempt work permits for certain categories, such as Intra-Company Transfers and International Mobility Programs.

The employer in Canada must apply for an LMIA through Service Canada and provide proof that
they have attempted to recruit Canadian citizens or permanent residents for the job. If the
LMIA is approved, the foreign worker can then apply for a work permit.

No, you cannot apply for an LMIA-based work permit on your own. The employer in Canada is responsible for obtaining the LMIA, and you, as the foreign worker, apply for the work permit
once the LMIA is approved.

The validity of an LMIA-based work permit can vary depending on the specific job offer and the terms of the LMIA. It may be issued for a specific duration, usually up to two years, but it can be extended or renewed in some cases.
In most cases, you cannot change jobs with an LMIA-based work permit. These work permits are tied to a specific employer and job. If you wish to change employers or job positions, a new LMIA and work permit may be required.
Yes, your spouse or common-law partner, as well as dependent children, may be eligible to apply for open work permits or study permits to accompany you while you work in Canada.
Depending on your qualifications and the job, you may be eligible to apply for permanent residency in Canada through various programs like Express Entry or Provincial Nominee Programs while on an LMIA-based work permit.
